The Legislature of the City of Buenos Aires reformed the Contraventional Code to incorporate the digital impersonation of identity among other faults and contraventions.

On January 4th 2019, the Legislature of the City of Buenos Aires enacted law No. 6.128 amending  the Contraventional Code, by means of which, among other things, Chapter V on infraction to the digital identity of the Internet is incorporated.


New guidelines of best practices for the application of Law N° 25,326

The Agency of Access to Public Information (“AAIP”) has approved guiding principles of best practices for the application of the Argentine Data Protection Act N° 25,326 by means of Resolution 4/2019. 


Brasil: La Medida Provisional Nº 869/18 modifica artículos de la Ley General de Protección de Datos y crea la Autoridad Nacional de Protección de Datos

El pasado 28 de diciembre de 2018 se publicó en el Boletín Oficial de Brasil (Diário Oficial da União) la Medida Provisional N° 869/18 (la “Medida Provisional”), la cual promueve algunas modificaciones a la Ley General de Protección de Datos (LGPD -Ley N° 13.709/2018) promulgada en agosto de 2018 y crea la Autoridad Nacional de Proteccion de Datos Personales (“ANPD”).


Nueva Disposición de la Dirección Nacional de Derechos de Autor

El pasado 18 de diciembre de 2018 se publicó en el Boletín Oficial la Disposición N° 15/2018 de la Dirección Nacional del Derecho de Autor, dependiente del Ministerio de Justicia y Derechos Humanos. 


New guidelines for binding corporate rules (BCR) – Argentine Agency of Public Information

Resolution N° 159/2018 from the Argentine Agency of Public Information (“AAPI”) has been recently published in the Official Gazette. This Resolution implies new guidelines and basic contents for binding corporate rules (“BCR”).
The principal aim of the AAPI implies the establishment of certain basic rules for the design of the policy documents regarding company self-regulation of the same economic group for international personal data transfers. In other words, the Resolution provides in Annex I a reference document to design BCR. 
In this way, every company that executes international data transfers to jurisdictions with non-adequate levels of protection, and have celebrate self-regulation rules in order to justify the transfer, must submit this rules before the AAPI for approval. The submission has to be done within 30 days following once the data transfer is executed.
